DairyBase is a product and service provided by DairyNZ Limited to give you a way to keep track of your farms physical and financial performance. Reference to the term DairyBase in these terms covers all products and services that are provided in respect of the service and related products and services such as the Baseline Project and the Econ Tracker Tool.

In these terms and conditions the expressions ‘we’, ‘us’, Company and ‘our’ are a reference to DairyNZ Limited and its contractors.

‘You’ or ‘your’ is a reference to the entity (company, partnership, trust) or the individuals that register to use DairyBase. You are also responsible for the actions of anyone who uses the service through your login. If an entity is registering to use DairyBase then the person completing the registration must be authorised to accept these terms of use.

When you register to use DairyBase you agree to be bound by these terms and conditions. If you do not accept these terms and conditions, you need to cancel your registration and stop using the service.

We reserve the right to amend these terms and conditions from time to time. Amendments will be effective immediately upon notification on this website. Your continued use of the website following such notification will represent an agreement by you to be bound by the terms and conditions as amended.

Registration

Registration to use DairyBase can either be done online, in person with one of our team, or by completing paper registration.

Provision of Information

You agree us entering, retaining and using information about you that has been provided by or collected from:

  1. You;
  2. Your agents;
  3. Us;
  4. Other third parties who you have agreed can provide information.

We recommend that you provide information on a seasonal basis to get the most out of your analytics but you are not required to do this.

In order for you to get the most benefit from DairyBase full information (including physical, environmental and financial information) should be provided.

Information can be provided online, in person with one of our team, by submitting it in writing, or by any other means.

Use and Provision of Information

We will only provide reports generated specifically for you, to you or to those people or entities that you have authorised.

If information that has been provided by you is used in any way that does not identify it as your information when reported on, you allow us to provide this information in any format to any other person or entity for any purpose, including:

  1. To combine with other users’ information to produce comparative or benchmark reports;
  2. To generate information for the industry;
  3. For use by entities to perform services for, or on behalf of us;
  4. To make policies and procedures, to lobby government and industry and for advocacy purposes;
  5. To contribute to dairy industry statistics or benchmarking
  6. For other purposes relating to the dairy industry.

We may disclose your information to regulatory authorities, tax authorities and/or investigating authorities, where:

  1. we are obliged to do so by law or regulation; or
  2. we are responding to a request, including where there is a significant health and welfare issue (including for animals); or
  3. you have provided instructions to us to allow this information to be disclosed.

Access and Correction of Information

You can update your information using your DairyBase login. You can also view the information that has been entered on your behalf.

Protection of Information

On registration you receive a username and password. You are responsible for keeping this secure and we recommend that you change your password periodically. When you log on the DairyBase system, a secure server is used. Secure Sockets Layer (SSL) encrypts the information you send through this web site.

We will take all reasonable steps to prevent loss, misuse, or disclosure of your information. All information is stored on secure cloud based services. Access is restricted to authorised engineers and support staff from within DairyNZ and our IT service partners.

Ownership of Information

When we process information and generate reports, the generated data and reports remain the property of us and can be used by us in any manner (subject to any exceptions contained in these Terms of Use).

Reliance on Information and Reports

Information and reports that are produced by us are dependent on the accuracy of the information and information that is provided by you and others. Therefore we make no representation or warranty of any kind in respect of the accuracy of the information and accept no responsibility or liability for any loss arising from reliance on the information.

Communications

We will sometimes send you further information about DairyBase and other services that we and our affiliates provide. This information will be communicated via the contact details that you provide. If you do not want to receive this information then you need to contact info@dairybase.co.nz or 07 858 3890.

Privacy Act 2020

If you are an individual, then the information that we hold is subject to the provisions of the Privacy Act 2020. Please see our Privacy Policy for further information about our obligations to you in respect of personal information.

Cancellation

We can, at any time, without notice to you, decide to stop providing this service to you. If you no longer wish to use this service, or want to temporarily suspend use, you can advise us by email at info@dairybase.co.nz.

Your dormant profile will remain on DairyBase and can be reactivated if required. If you prefer that all contact information is removed, then you can specify this at time of deregistration. Information that has been used for other purposes (such as the production of reports) is unable to be removed from DairyBase.

Governing Law

The governing law shall be the laws in force in New Zealand. The parties submit to the jurisdiction of the New Zealand Courts.
