Your privacy is important to us at DairyNZ Inc, DairyNZ Limited and New Zealand Animal Evaluation Limited (DairyNZ, we, us). We take the responsibility of handling your personal information very seriously.

This Privacy Notice applies to the personal information we collect, use, disclose and store in the course of providing our products and services. Please read it alongside any agreement you have with us and our Website Terms of Use. Note that “personal information” is any information about an identifiable individual. It doesn’t need to name you if you are still identifiable in other ways.

Overview

To make it easier to understand, we’ve summarised our approach in this Overview section. More detail is set out in the following sections of this Privacy Notice.

1. We collect a range of personal information to provide our services, including your contact details, information under the Commodity Levies (Milksolids) Order 2020, your date of birth, ethnicity, gender and information about your use of our services, such as attendance at events and engagement with our websites and apps.

2. We use your information for purposes like communicating with you, calculating the milksolids levy, registering you for events or workshops, providing our products and services and running our business. Dairy farmers are required to provide us with their personal information under the Commodity Levies (Milksolids) Order 2020 but otherwise you don’t have to give us all the information we ask for (thought this might mean you’re not able to access our full range of services).

3. We collect your information directly from you when you interact with us and use our services. We may also collect your information from third parties like our research partners and dairy industry stakeholders with whom we partner.

4. We protect your information and delete it once we no longer need it.

5. We may sometimes need to share your information with third parties so we can provide our services and run our business. See section 6 for more detail.

6. You have rights to request access to your personal information and for it to be corrected. You can contact us at privacyofficer@dairynz.co.nz with any concerns.

1. What personal information does DairyNZ collect?

We may collect the following types of personal information in the course of providing our services:

  • Contact details, such as your title, name, address, phone number and email address.
  • Details of the organisation you work for, including your role and, where relevant, farm location.
  • Information collected on dairy farmers through milk processors under the Commodity Levies (Milksolids) Order 2020, including business and individual farmers’ names, contact details, unique supplier and party numbers (i.e. unique identifiers generated and allocated by milk processors), the monthly volume of milksolids sold to dairy processors, the related amount of levy money payable and levy payment records.
  • Additional DairyNZ membership details, including your annual milksolids production details.
  • Demographic information such as your date of birth, gender and ethnicity (including iwi and/or other affiliations) to help us identify and engage with different groups.
  • Information about your attendance at any events run by us or other organisations that we partner with to deliver events.
  • Payment details like bank account numbers and your order and payments history. We do not collect or process credit/payment card details.
  • Information indirectly collected by us through our subsidiary, Dairy Training Limited, in relation to the courses they run, including your contact details, academic history, National Student Number, citizenship, disabilities and education history.
  • Information relating to your communications with us, such as your emails, letters, contact through our website, social media accounts or messaging apps, notes we take of discussions with you (e.g. during farm visits), your completion of registration forms and survey responses and any recordings of telephone calls with you.
  • Information about your use of our websites and apps, including your IP address, operating system and browser details, login information, screen and device settings (such as the point and scroll settings of your mouse), time zone settings and your activities on our sites, including search terms, pages you visit, actions you take, the websites you visit before and after our own and the dates and times of your visits. You can disable cookies at any time by changing your browser settings but please be aware that this may mean not all of the functions of our online properties will be available to you.
  • CCTV footage of you if you visit our physical premises, including the research and demonstration farms we operate.

If you need to give us the personal information of someone else (e.g. a colleague, employee or family member), please ensure you get their consent for us to collect, use and, where necessary, disclose their information. You are also responsible for communicating the contents of this Privacy Notice to them.

2. Why does DairyNZ collect my information and what is it used for?

We collect and use the personal information outlined above for the following purposes.

  • To provide our products and services to you, including the likes of DairyBase, feed budgets, body condition scoring tools and other relevant information, resources, guides and templates.
  • To calculate the milksolids levy payable by dairy farmers under the Commodity Levies (Milksolids) Order 2020.
  • To add you to the DairyNZ Members’ Register if you pay the milksolids levy.
  • To process your orders, payments and, where necessary, recover any debt owed to us.
  • To register you for events or workshops promoted or hosted by DairyNZ and our partners and to facilitate delivery of such events.
  • To support engagement and relationship building, including facilitating cross-industry connections. For example, bringing together farmers with similar interests, needs and challenges, such as emerging farmers.
  • To communicate with you about our activities, products and services across a range of media and digital platforms, including by sharing marketing or promotional content with you about our products, services, the value we provide and our overall activities and event.
  • To support you, emergency services, regional or central government during natural disasters, severe weather, biosecurity incursions and other emergency situations.
  • To help us understand how to improve and develop our websites, products and services, including conducting analysis of trends and strategies.
  • To help us run and improve our business systems, processes and infrastructure, including for research, quality control and staff training purposes.
  • To assess and verify new clients and stakeholders, such as organisations to which we provide research services and those with an interest in the dairy industry, including to explore whether collaboration with them is viable and to respond to enquiries about doing business with us
  • If you are a stakeholder or client of DairyNZ, to process your personal information for administrative purposes, including to send you invoices, information about the status of your orders and to process your payments.
  • To keep staff and visitors safe.

We may also collect and use your personal information for other purposes where you have authorised us to do so or we are permitted or required to do so by law, including in connection with legal proceedings or the prevention, detection or prosecution of crime or fraud.

3. What happens if I don’t give DairyNZ my personal information?

Dairy farmers are required to provide their personal information to DairyNZ via dairy processors under the Commodity Levies (Milksolids) Order 2020 (the Milksolids Order) so we can calculate what milksolids levy is payable. Levy payments fund DairyNZ’s activities to promote dairy farmer’s interests including research and development, biosecurity, farmer extension and education, and advocacy.

You are not required to provide us with any other personal information, but if you choose not to then we might not be able to make all our products and services available to you. For example, if you don’t give us your contact details, we won’t be able to communicate with you, register you for our events, process your orders or keep you updated on industry news and events, programmes and training.

You can opt out of receiving marketing and promotional email and text messages by clicking on the available “unsubscribe” links in those messages or by emailing us at privacyofficer@dairynz.co.nz.

4. Where does DairyNZ get my personal information from?

We mostly collect your personal information directly from you. For example, when you interact with us by registering to attend our events and training, sign up for newsletters and emails or use any of the products and services we provide.

We also collect some personal information indirectly through others. For example, we collect information under the Milksolids Order through dairy processors like Fonterra, Synlait and Open Country Dairy. We also collect personal information through our subsidiary, Dairy Training Limited, our research partners and other dairy industry stakeholders, including the likes of Zoetis, LIC and CRV.

We may also need to collect your personal information from other third parties in various circumstances, including where it is not reasonably practical for us to collect that information directly from you.

5. How does DairyNZ protect my information?

DairyNZ takes all reasonable steps to protect the personal information we hold from loss, misuse, and unauthorised access, disclosure, alteration and destruction.

DairyNZ service providers processing personal information on our behalf are contractually obliged to maintain the security and confidentiality of any personal and/or sensitive information they handle as data processors.

6. Who do you share my personal information with?

We may share your personal information with the following types of organisations to help us provide our products and services to you. These organisations are required to only use the personal information we disclose to them for the purpose of supporting the services that we provide to you, including running events.

  • Related companies: We may share your personal information with our related companies, including Dairy Training Limited and New Zealand Animal Evaluation Limited to support and improve the design and delivery of our products and services across the group, to identify further products and services that we believe are likely to be of interest to you and/or to operate our businesses;
  • IT and professional service providers: We share your personal information with various service providers that help us to provide our products and services. For example, service providers that host or maintain our underlying IT, infrastructure and hosting services, data centres and communications systems, as well as the agents and business partners that enable us to perform our business activities. However, mostly those service providers will be processing your personal information on our behalf as agents and in circumstances where we remain responsible for it at all times.
  • Other disclosures: We may also share your personal information with other third parties where:
    • we have your consent and/or authorisation
    • the disclosure directly relates to the purpose for which we collected the information
    • we reasonably believe there is a serious threat to someone’s life, health or safety
    • there is a proposed purchase, sale or merger of our business or assets
    • we are required or permitted by law to do so (including to regulators, law enforcement bodies, government agencies, courts or other third parties) and/or to exercise, establish or defend our legal rights.

7. How long to you keep my information for?

We keep your personal information for as long as we need it to provide our products and services. This is a case-by-case determination depending on things like the nature of the data, why it was collected and our legal or operational requirements.

8. Your rights

You have the right to ask for a copy of any personal information we hold about you and to ask for it to be corrected if you think it’s wrong. To make a privacy request, update your information or tell us about any concerns, please email us at privacyofficer@dairynz.co.nz. We may need to verify your identity before releasing or correcting your personal information so we can make sure it relates to the right person.

We may also need to charge our reasonable costs for providing copies or correcting the requested information. We’ll only withhold information for limited reasons and we’ll explain why if this happens. We’ll make suitable corrections that we can reasonably make, and if we can’t make the requested change we’ll note this on the relevant personal information.

We will respond to requests for information as soon as reasonably practicable, noting the impact of factors such as the method of communication, whether a third party needs to be consulted, the type or amount of personal information requested and the manner in which personal information is held.

10. Changes to this Notice

We review this Privacy Notice regularly to ensure it remains accurate and up to date in terms of our operations and legal requirements. We may need to update it from time to time. When we do, we will publish the revised version at www.dairynz.co.nz/dairynz-limited-privacy-notice. We encourage you to check back frequently for any updates. The latest version and publication date will always be clearly marked so you can be aware of when the notice was last changed. We will endeavour to communicate material changes that are directly relevant to you by email or website notification within a reasonable timeframe.
